The ILD

The Institute for Liberty and Democracy (ILD), led by Peruvian economist Hernando de Soto, works with developing countries to implement property and business rights reforms that provide the legal tools and institutions required for citizens to participate in the formal national and global economy. ILD works toward a world in which all people have equal access to secure rights to their real property and business assets in order to pull themselves—and their countries—out of poverty.

Why is the Tunisian Economy Breaking Down?

The Tunisians are richer than they think

UTICA (Union Tunisienne de l’ Industrie, du Commerce et de l’Artisant) is an organization that represents Tunisian employers in the industrial, commercial and artisanal services sectors. Orga- nized regionally and according to sector, UTICA is Tunisia’s largest employer organization, acting as the public voice and defender of its members’ social and commercial interests

The ILD is a Peru-based think and action tank dedicated to understanding through fieldwork the legal causes of economic exclusion and providing governments and civil institutions the means to build an inclusive rule of law in order to benefit from the positive aspects of globalization —and defend themselves from the negative ones.


Objective of the Study

UTICA and ILD have decided to collaborate during the next year on a research project based on their shared beliefs —that during the past two centuries, history has demonstrated throughout the world that entrepreneurship creates wealth; and that the Arab world —and Tunisia in particular— is teeming with ambitious, talented entrepreneurs.

The project will address a nagging question among business leaders in the region: Why are Arab entrepreneurs not meeting their potential for producing prosperity —for themselves and their countries? That’s why the research project has been titled “Why has the Tunisian economy broken down?”

Based on daily observations and complaints received from formal entrepreneurial leaders in the MENA region and the preliminary results of ongoing ILD field research begun in 2010 soon after the breakout of the “Arab Spring,” we can start off with a quick answer: What is holding Tunisian entrepreneurship back is an excess of business carried out extralegally, outside the rule of law.

L´UNION TUNISIENNE DE L´INDUSTRIE, DU COMMERCE ET DE L´ARTISANAT (UTICA) est la plus grande organisation patronale en Tunisie, et représente les dirigeants des entreprises des secteurs industriel, commercial, services et artisanal. Entre autres activités, l´UTICA participe activement, auprès des pouvoirs publics, à l’élaboration et à la mise en application d´une politique économique et sociale susceptible d´assurer progrès et prospérité à tous les agents économiques; et mettre en place une stratégie et un programme d´action afin de participer au développement économique du pays dans tous les domaines liés à l´entreprise et notamment l´emploi, l´exportation, l´investissement et le développement régional.

L’ILD est un groupe de réflexion et d’action, dont le siège social est situé au Pérou. Il se consacre, par le biais d’un travail sur le terrain, à la compréhension des causes juridiques de l’exclusion économique et à la présentation aux gouvernements et aux institutions civiles des moyens permettant de mettre en place un Etat de droit inclusif, afin de bénéficier des aspects positifs de la mondialisation – tout en se protégeant de ses aspects négatifs.


L’objectif de l’etude

L’Union Tunisienne de l’Industrie, du Commerce et de l’Artisanat (UTICA) et l’Institut pour la Liberté et la Démocratie (ILD) ont décidé de collaborer dans le courant de l’année 2013 sur un projet de recherche s’appuyant sur une conviction commune : au cours des deux derniers siècles, l’histoire a démontré que l’entreprenariat créait de la richesse et que le monde arabe – et en particulier la Tunisie – regorgeait d’entrepreneurs ambitieux et talentueux.

Le projet abordera une question lancinante parmi les hommes d´affaires de la région : pour quelle raison les entrepreneurs arabes ne parviennent-ils pas à exploiter pleinement leur potentiel afin d´amener la prospérité, tant pour eux-mêmes que pour leurs pays ? C´est pourquoi le projet de recherche est intitulé « L´économie informelle : comment y remédier? ».

Sur la base de nos observations quotidiennes, de l´écoute de plaintes d´entrepreneurs formels de la région et des résultats préliminaires d'une étude de l´ILD portant sur la région MENA après le printemps arabe – qui sera décrite brièvement ci-après –, il est possible d´apporter un début de réponse: ce qui bride l'entreprenariat tunisien est un excès d'activités commerciales menées extralégalement, à savoir en marge de la règle de droit.
